Would Charter House Take Down the Billboards With Sarkodie On As Performing Too? | Here is A Photo + My Take

Yesterday, Charter House-organisers of  the annual Ghana Music Awards were compelled by Ghanaian musician-Sarkodie, his fans and the many Ghanaian bloggers who jumped on the issue of the company’s usage of the artiste’s name as a performing act in this year’s Ghana Music Awards without his consent or any contract.

I commented on this yesterday—and explained the legal position and implication of such actions. In my comment, I stated among other things that; “Charter House’s usage of his [Sarkodie] name in their commercial when they had not paid or hired him for such a performance breaches both his statutory right of publicity and his common law invasion of privacy right.

It’s interesting how this is playing out on twitter—if it was in the United States or United Kingdom, the artiste would be in court, seeking for the appropriate damages. If a big event company such as Charter House does not really give a hoot about what the law says at any point in time, what do you expect the smaller event organisers to do—and more also, are they not the same organisation in court seeking to have the law in action in relation to the Shatta Wale’s defamation case?

That is the sort of irony grounded in the way Charter House seems to be operating.

There is law to enforce when someone violates one in relation to them but they seem to continue to violate the same law (in other form) when dealing with others.

All around the world, the law is pretty simple on this; “a person shall not use any aspect of an individual’s persona for a commercial purpose…The person’s persona could include his or her name, voice, signature, photograph, image, likeness, or distinctive appearance, if any of these aspects have commercial value”.

Later in the day, Charter House issued a carefully put together press release to apologize to Sarkodie and his fans, calling what has happened a mistake—but it seems they LIED in their press release about this so called mistake.

In their apology press release, Charter House said;

“We would like to expressly state that Sarkodie IS NOT performing at the 16TH VODAFONE GHANA MUSIC AWARDS. Prior to this, we had been communicating and had met with a member of his management team trying to arrive at a favourable figure.

In anticipation of that figure coupled with the unstable power situation in the country plus the long Easter weekend ahead of us, where it would be almost impossible to get a studio to record, we worked ahead and recorded different versions of the 16th VGMA’s final event radio commercial.

One with Sarkodie’s name and another without. With our fingers crossed, the ads were all submitted to our media manager. Unfortunately, we were unable to come to a favourable agreement and parted ways amicably.

Our media manager was immediately informed on Thursday evening to send out only the ad that DID NOT HAVE Sarkodie’s name. This, she did except for YFM, where she sent the wrong ad which had Sarkodie’s name.

Clearly, it was an error from our end which we have totally admitted. We hereby unreservedly apologise to Sarkodie, his management friends and fans as well”

You can see from the part I have ‘bolded’ that Charter House seem to suggest that they honestly erred with the audio commercial by sending out a wrong one, and not that they had a clear intention to infringe on Sarkodie’s personality right, but from the billboard above—their explanation falls flat on its face.

Looking at the billboard, it shows images of Sarkodie and Samini performing and as such, there should not be arguments such as the two having been used on the billboard as nominees for the awards publicity—the obvious inference or message the billboard sends is that; the two will be performing at the Ghana Music Awards 2015.

Ghana To Play Mozambique, Rwanda, And Mauritius In AFCON 2017 Qualifying

The draw for qualification for the next African Cup of Nations has seen Ghana drawn in a comfortable looking group consisting of Mauritius, Mozambique, and Rwanda.

The draw was held by the CAF executive committee, who earlier had granted hosting rights for the tournament to Gabon.

Gabon would partake in the qualifiers, but their results would not count in the final reckoning as they automatically qualify as hosts.

The qualifying games begin in June this year, ahead of the tournament in January 2017. The group winners from all thirteen groups would make the tournament, to be joined by two best second placed teams and the hosts.

The Confederation of African Football (CAF) has chosen Gabon to host the 2017 African Cup of Nations.

The final draw came down to bids from Algeria, Ghana, and Gabon, but the Confederation’s executive committee decided on our West African neighbours.

Gabon co-hosted the tournament with Equatorial Guinea in 2012, and has now also earned sole hosting rights after the Equato-Guineans also hosted the 2015 edition.

But I have never been to Japan and any of its competing countries which use intriguing modern technology all around, including in their restaurant.

The below video was shared with me on facebook by a friend—and after watching it; I asked ‘God when will Africa get there?’. Take note of my use of the word-God here…

Anyway, this restaurant is super efficient, simple and beautiful—all made possible by modern technology. The restaurant has no chef and has less than 15 staff—and yet, it can serve 196 customers at a time.

Stories of police brutally against unarmed blacks in the US has become something of a staple these days. Eric Garner and Michael Brown just two of the highest profile in recent months.

Often the officers involved are acquitted, leading to much outrage from the African American community. In the latest case, however, the officer involved has been charged with murder; but after a video of the incident was released.

The officer, from Charleston, South Carolina, is Michael T Slager. The victim, Anthony Scott, was stopped for having a broken rear light. He fled, and the officer chased him to a point where he stunned him with his stun gun.

Apparently that didn’t stop him, so he took off, at which point the officer fires 8 shots in quick succession. He got hit and fell to the ground.

Any time I come across such developments, I smile—because this is what Africa ought to be like; take those enjoying monopoly and enforcing any sort of unfair pricing systems to the court.

Sadly, this didn’t happen in Ghana and I wouldn’t dare say we do not have the balls to take such things on—but we surely need to learn how to make good use of our courts and embrace class actions against those corporate giants whose motives are simply; to make huge profits irrespective of the consumer consequence.

All around the world, especially in the United States and UK, ordinary citizens put their interests and worries together to sue big companies such as Google, Tesco, Walmart, Nortel Networks, AOL Time Warner, and the others in class actions all the time—a clear indication that there is might in collective citizenry power even if mounted against the richest companies.

All across Africa, MultiChoice/DSTV continues with their regular price increase—while content does not significantly increase, cost does for subscribers who just endure the hardship.

The company’s plan to introduce its new increased price has been halted in Nigeria, albeit temporal, it serves the fact that, subscribers can actually challenge these companies enjoying monopoly in Africa—which has somewhat turned into exploitation.

Even though it’s absurd for a parent to brutally mistreat his/her biological child, parental cruelty exist all around the globe in different ways. It comes as a great shock when the reasons behind such inhumane acts are unjustifiable.

A 25 year old unemployed Ghanaian woman has allegedly boiled the hands of her 9 year old son at Kwabenya – Accra. The accused, Emelia Ofosu , is said to have put the hands of her son in a boiling water for squandering GH₵1 given to him as refuse dump fee, the Daily Graphic reports.

Narrating the chronology of event to the newspaper, ASP Christine Sropenyo, said Emelia asked his son whom she had given GH₵1 as garbage fee to go and dump the refuse at the dumpsite. The boy, playing a smart move on the mother decided to throw down the garbage at the backyard of a neighbor and pocketed the money.

By default, any reasonable human being whose house had been turned into a dumpsite would react and that was exactly what Emelia’s neighbor did the next morning. She confronted Emelia and accused her of using her backyard as a refuse dumpsite.
