The Supreme Court of Ghana has ruled that people suspected of rape, murder, and narcotics related offences can apply for and be granted bail.
The Court ruled, via a 5-2 majority decision, that Section 96(7) of Act 30, which rules the three above offences as non-bailable, is an unconstitutional measure.
The court thus struck out the law, which has long held that such suspects could not be granted bail.
The ruling, handed down Thursday, comes after a private lawyer, Martin Kpebu, filed a suit last year seeking the Supreme Court to declare the law unconstitutional.
The court, in a separate ruling today, directed the Electoral Commission to clean up the voter’s register prior to the elections to be held this November.
