The KKD Rape/Sexual Assault Allegation Saga | What the Police is Saying + Is the Allegation Rape or Sexual Assault?

According to reports, the Public Relations Officer (PRO) of the Accra Police Command, ASP Afia Tenge stated last night that even though KKD is being held for allegedly ‘sexually assaulting somebody’ he has not been formally charged yet.

Let’s take note of the police’s use of the phrase ‘sexually assaulting somebody’ and media reports usage of the same phrase or the other ‘allegedly raping a girl’. When it comes to most people, rape is a sexual assault—and as such, they use the two words interchangeably though legally, they have different and specific meanings.

So the usage of the ‘sexually assaulting somebody’ by the police does not mean, we do not have a rape allegation on our hands as others are saying—it could just be that people are not using these words in their strict legal forms such as how we mostly use assault when we are technically or specifically referring to battery…

ASP Afia Tenge told CitiFm yesterday that, “He [KKD’ is being held for allegedly assaulting somebody sexually. He has not been charged now for any offence, till we get preliminary evidences or material to prosecute him according to the charges that will be proffered against him depending on the evidence that we get.”

The Public Relations Officer (PRO) of the Accra Police Command  has earlier stated that “the law requires that in 48 hours of being arrested you are sent to court for the court to determine whether or not you are supposed to be remanded or released on bail” .

“(KKD) has his rights and we will do as much as we can professionally as police officers to be able to work within the time frame that the constitution mandates and after that we are going to prosecute him accordingly.”

On the identity of the victim, the police said, “she is not a minor,” dismissing suggestions that she might be underage. “For now we want to protect her identity “, ACP Tenge stated.

On police investigation and statement, ACP Tenge mentioned that, investigation is  “still premature for the police to make any further statements unless we have been able to delve into the issues.”

Our Ghana police source has hinted that, KKD may be processed for Court today…
