You know how rich men who flout the law always have deep pockets to keep on legal battles for years, so that whatever judgement has been held against them becomes essentially meaningless?
No? Then pay attention.
Alfred Agbesi Woyome’s next step in the case involving the Supreme Court ordering him to repay Ghc 51.2m, according to his lawyer, is to head to the International Chamber of Commerce.
Lawyer for the businessman, Ken Anku, confirmed to the Daily Graphic that was indeed the next plan of action for the businessman. This was after a suit by a private individual, Abdulai Yusif Fanash Muhammed, seeking a review of the Supreme Court’s earlier decision, was thrown out by the Court.
Muhammed’s suit sought to declare that the Supreme Court had no jurisdiction over the contract signed between Woyome and government, as the contract was not an International Business Transaction, as stipulated in article 181 of the constitution.
But the court disagreed, judging the case as frivolous. Woyome’s lawyer said that’s the same interpretation they would be seeking at the International Chamber of Commerce, since the Supreme Court would have no locus if the contract was not as stipulated in the constitution.
This is despite the fact that his lawyer claimed they had nothing to do with Muhammed’s suit, but somehow they are headed for international arbitration with the same argument he used.
The Supreme Court ordered the businessman to pay to the state, Ghc 51.2m that was initially awarded to him as ‘judgement debt’, after he claimed government reneged on a contract he signed with them.
