NDC MP Ras Mubarak To Sue Hajia Alima Mahama For Firing Of All MMDCE’s

Member of Parliament for Kumbungu, Ras Mubarak, has threatened to sue Local Government minister designate, Hajia Alima Mahama, for ordering that all Metropolitan, Municipal and District Chief Executives (MMDCE’s) vacate their offices.

According to the NDC MP, Hajia Alima has no locus to take that action since she has not been sworn in as a substantive minister, therefore he is giving her and government till Monday to reverse the action or face him at the Supreme Court.

Hajia Mahama took the decision on behalf of the President and noted as such in her letter asking all MMDCE’s to leave their posts, but Mubarak believes she cannot be the one to take that action.

He wrote on Facebook:

“She [Alima Mahama] has no such powers and, as a lawyer, ought to have known that she can’t act on behalf of the President until parliament vets and approves her nomination. They are beginning to make a total shambles of running the country.”

He later deleted the above post, but added another one with the threat to take the case to the Supreme Court if the right thing, in his view, is not done.

He wrote:

Under Admin Law & Practice, u need to appoint someone properly before they can act on your behalf. I insist that Hon. Hajia A. Mahama doesn’t have an instrument of appointment and cannot be directed or assigned to act on behalf of the President of Ghana. I’ve instructed my lawyers to challenge the legality of this fake directive at the Supreme Court of Ghana if the NPP government doesn’t do the right thing by Monday. They have every right to sack people appointed by President Mahama, but it has to be done within the law.
