Unexplained Wealth To Be Criminalized In Ghana – Special Prosecutor

Under the current laws of Ghana, unexplained wealth is not a criminal offense and one can amass as much wealth as he wants without being investigated.

Special Prosecutor, Mr. Martin Amidu has however pushed for the amendment of the law and seeks to investigate any individual the Office of the Special Prosecutor sees to be holding unexplained wealth.

When this agenda goes through and both Criminal Offences Act, 1960 (Act 29) and the Special Prosecutor Act, 2017 (Act 959) is amended, the burden of proof will be on public servants and private individuals to explain their excess earnings and failure to do so would lead to prosecution.

Also, bank accounts of persons suspected to have committed any criminal offense can be investigated by the Office of the Special Prosecutor.

The agenda according to Mr. Martin Amidu is part of the 2020 Anti-Corruption Program launched by the Office.
